Supreme Court Decision on Transgender Athletes Generates State-Level Actions

The Supreme Court recently ruled that states can choose to restrict transgender girls and women from participating in female sports events. This decision allows 27 states to maintain their existing bans without mandating changes in the remaining 23 states; however, pressure from various advocacy groups is mounting.

Kristen Waggoner, president of the Alliance Defending Freedom, publicly encouraged states to enact similar laws. Her organization supported the legal battles in Idaho and West Virginia that led to this ruling. Both states’ laws were upheld, potentially setting a precedent for other states to follow.

Efforts to address transgender athlete participation are progressing in Democratic-majority states like Colorado and Washington. Concurrently, the Trump administration has initiated several investigations into such policies. The Justice Department has also filed lawsuits to challenge laws in California and Minnesota that protect transgender athletes’ rights to compete in accordance with their gender identity.

The topic could impact upcoming midterm elections. A recent Gallup survey found that about two-thirds of adults, including 40% of Democrats, think transgender athletes should compete on teams matching their birth-assigned sex. This has placed additional political pressure on Democratic candidates.

Even within the Democratic party, some like California Governor Gavin Newsom have voiced concerns. For instance, a transgender high school senior in California won two state titles, sharing victories with a female competitor behind her, which has sparked debate over fairness.

All 27 states implementing these bans are governed by Republican legislatures. Following the Supreme Court’s ruling, transgender advocates emphasize the need to reinforce pro-transgender participation policies in Democratic-led regions.
