Body Cameras for ICE Traffic Stops and New Hampshire Lawmaker’s Legal Battle

The White House has issued new guidance requiring Immigration and Customs Enforcement (ICE) agents to wear body cameras during traffic stops, following recent fatal incidents. Former Acting DHS Secretary Chad Wolf discussed this on ‘America Reports.’

In a related matter, New Hampshire state Rep. Ellen Read’s case has highlighted the issue of police body cameras. Read is contesting charges resulting from two high-speed traffic stops in Rockingham County. The lack of body and dashboard camera footage has become central to her legal defense. She argues the stops violated a New Hampshire constitutional provision protecting lawmakers traveling to and from legislative duties.

Major Christopher Bashaw of the Rockingham County Sheriff’s Office confirmed to Fox News Digital that his department does not use such cameras due to funding constraints. New Hampshire created a grant program in 2021 to help agencies purchase and maintain body and dashboard cameras.

Read has voiced her support for body camera legislation but questions other law enforcement expenditures. She disputed claims that she recorded the stop on her cellphone, clarifying that a witness provided testimony about the encounter.

Read contends that the constitutional provision is meant to prevent delays, not provide immunity from prosecution. Despite admitting to speeding, she disputes the alleged reckless driving at 107 mph.

Professor Lawrence Friedman of New England Law explained the historical context of the constitutional provision, stating it was designed to facilitate legislative duties without granting immunity from routine legal accountability. The New Hampshire Supreme Court declined immediate review but has not ruled on the merit of Read’s argument.

Bashaw noted that the constitutional language aims to protect legislative processes, not shield lawmakers from accountability in cases of dangerous driving. Read acknowledges the provision may need updating to reflect modern realities while retaining its original purpose.
