Trump Administration Seeks Removal of Federal Reserve Governor Lisa Cook Amid Legal Battle

The Trump administration is persisting in efforts to remove Federal Reserve Governor Lisa Cook. This move follows a Supreme Court decision that temporarily allowed her to remain in her role while contesting the president’s removal attempt over disputed mortgage fraud allegations.

In June, the Supreme Court ruled 5-4 that Cook, a nominee of President Joe Biden, could keep her position while her lawsuit against the removal continues. The administration is appealing a lower-court decision that favored Cook.

Chief Justice John Roberts noted in a footnote that President Donald Trump could attempt to terminate Cook again with proper notice and an opportunity for her to contest it. Trump expressed intentions to take immediate action following this decision.

Recently, a letter from White House aide Dan Scavino informed Cook of a potential removal, respecting the court’s mandate for proper notice and allowing her until August 26 to challenge this decision.

The effort to dismiss Cook traces back to a criminal referral made by Bill Pulte, director of the Federal Housing Finance Agency. Pulte accused Cook of mortgage fraud, claiming she declared two properties as primary residences—one in Ann Arbor, Michigan, and another in Atlanta. Declaring a property as a primary residence can lead to benefits like lower mortgage rates.

Cook has refuted these allegations strongly, arguing that her dismissal attempt is politically motivated. Her lawyer, Abbe Lowell, explained in a letter that Cook mainly resided in the Ann Arbor property, justifying its primary residence designation in a 2021 refinance application. It was also noted that an ‘isolated notation’ referred to the Atlanta condo as a primary residence in a July 2021 document, but earlier in May 2021, it was termed a vacation home.

The recent White House communication reiterates the previous allegations, which Lowell dismisses as groundless. He emphasized that under current facts and Supreme Court precedents, there is no valid reason for Cook’s removal. He affirmed that any new attempt will be legally challenged to safeguard Cook’s position and the independence of the Federal Reserve.

Lisa Cook continues her duties at the Federal Reserve amidst this legal dispute, with her team’s readiness to counter any initiatives affecting her role. Her presence remains significant to the institution’s historical and operational integrity.
