Defense Argues Against Death Penalty Aggravation

Tyler Robinson’s legal team is challenging the prosecution’s push for the death penalty. In a detailed filing, they claim that prosecutors have not established the necessary aggravating factors. They argue Robinson did not knowingly create a ‘great risk of death’ beyond the victim, Charlie Kirk.

Disputing the Prosecution’s Argument

The defense filing cites two major flaws in the prosecution’s arguments. First, the factual flaw: prosecutors did not identify anyone in the bullet’s path besides Kirk. Video evidence from the preliminary hearing showed that no one else was directly in the line of fire.

Second, the legal flaw: the state must demonstrate a ‘high probability’ of risk to others, not just a possibility. Prosecutors alleged multiple people were at risk during the shooting. However, Robinson’s lawyers contend the bullet, which hit Kirk on an elevated platform, traveled above the crowd.

Death Penalty Qualification in Question

The debate focuses on whether the case qualifies as aggravated murder, which is necessary for the death penalty in Utah. Prosecutors argue Robinson created a significant danger to others at the large event. But the defense claims the evidence does not support this, suggesting the aggravating factor should be removed, eliminating death penalty eligibility.

Political Motive Dispute

Robinson’s defense also challenges claims of political motivation. Prosecutors pointed to statements made by Robinson about Kirk’s political stance as evidence. However, extensive searches of Robinson’s belongings found no further proof.

The Utah County Attorney’s Office has until August 18 to respond to these defense claims. Judge Tony Graf Jr. will decide by September 1 on the continuation of the death penalty pursuit and whether there’s enough probable cause for trial.
