Justice Department Appeals Court Decision on Kilmar Abrego Garcia’s Smuggling Charges

The Justice Department has requested that a federal appeals court reinstate criminal charges against Kilmar Abrego Garcia, a Salvadoran man who was wrongfully deported by the Trump administration. This appeal comes after a lower court order dismissed the charges, labeling them as vindictive.

Background of the Case

In May, a federal judge in Tennessee dismissed the indictment against Abrego Garcia, who faced accusations of smuggling immigrants into the U.S. The judge determined that the charges were retaliatory, connected to Abrego Garcia’s challenge against his deportation to El Salvador.

Justice Department’s Argument

The Justice Department filed an appeal with the U.S. Court of Appeals for the 6th Circuit on Monday. They disputed the retaliation claim, asserting that multiple valid reasons existed for prosecuting Abrego Garcia. According to a news release, the decision to indict him for human smuggling was made by career prosecutors driven by evidence and law, believing in his guilt beyond a reasonable doubt.

The Department further wrote in their statement that the lower court’s decision represents an extensive expansion of judicial authority, allowing courts to dismiss serious charges based on supposed prosecutor motivations.

Current Legal Proceedings

Abrego Garcia was arrested last year, charged with two counts of human smuggling. These charges were a result of a traffic stop in Tennessee in November 2022, where state Highway Patrol found numerous individuals in his vehicle. Abrego Garcia pled not guilty to these charges.

Additionally, Abrego Garcia is part of another federal court case in Maryland concerning the Trump administration’s deportation efforts. Immigration and Customs Enforcement intends to deport him to Liberia, an effort currently halted by a federal judge.
