In a Texas courtroom, Nausheen Gilkar expressed her devastation over the situation. She accused the surrogate, McKenna West, of trying to gain control over the child. Tears filled her eyes as she declared the child was theirs, highlighting the emotional intensity of the case.
Background of the Dispute
The newborn, referred to as Rumi by Gilkar and Omar Ahmed, was diagnosed with hypoplastic left heart syndrome. This defect affects normal blood flow, which poses life-threatening risks if untreated. Around 1,000 newborns in the U.S. are diagnosed with this condition annually, according to the CDC.
The couple asserts the child’s condition has deteriorated significantly. Court documents detail complications following a surgical procedure, including the need for a blood transfusion.
Disagreements Over Medical Decisions
West, the surrogate, is seeking custody to make medical decisions for the child, whom she calls Gabriel. She claims Gilkar and Ahmed were not dedicated to ensuring the child received necessary medical treatment. This is contrary to what the couple wanted after learning about the diagnosis.
During the hearing, West revealed she had considered an abortion following the couple’s request but ultimately decided against it, believing the child had a good chance of survival.
Contractual and Legal Challenges
Gilkar and Ahmed claim West breached the surrogacy agreement established after multiple IVF attempts. Gilkar recounted significant medical challenges that led her to this surrogacy route, noting a hysterectomy left surrogacy as her only option.
West had lived with the couple in Los Angeles during the pregnancy. Despite court decisions in California dismissing her rights, West argued for her custodial rights given the child’s medical needs.
Surrogacy Laws and Interpretations
Surrogacy lacks federal regulation, resulting in varied legal interpretations across states. This absence of uniform laws complicates custody and parental rights cases like this. The court has yet to issue a decision, with the temporary restraining order preventing West from seeing the child still in place.
