In Plymouth, Massachusetts, the legal team for Lindsay Clancy and the state’s prosecutors have reached an agreement to delay the motion by defense attorney Kevin Reddington regarding the investigation of a holdout juror in her recent mistrial. Attorney Edward Paltzik explained this action to Fox News’ Kayleigh McEnany. The final decision awaits Judge William Sullivan’s approval, who has yet to announce a ruling.
Both the district attorney and Reddington have consented to postpone the motion to investigate the juror, Michael Desronvil. The reason for the delay is Desronvil’s counsel lacking access to necessary impounded information. Paltzik noted that a status conference is likely, even if the motion does not proceed immediately.
Michael P. Desronvil, who pressured the mistrial, has retained an attorney with a past controversial client, President Donald Trump. Clancy faced charges of three counts of first-degree murder regarding the strangling deaths of her children. Clancy is scheduled for a court status conference following the September 4 jury deadlock.
Paltzik highlighted the importance of local counsel presence at the court date, while noting that all decisions are under the judge’s discretion. The scheduled hearing was meant to discuss Reddington’s motion to investigate Desronvil and a motion seeking to dismiss charges under double jeopardy, avoiding retrial.
Reddington initially requested an inquiry into Desronvil, the sole juror finding Clancy guilty of murder, while the others believed Clancy should be found not guilty due to mental illness, citing postpartum psychosis.
The case involved Clancy’s children, Cora, Dawson, and Callan, killed at home in Duxbury, Massachusetts, in January 2023. The defense had raised an insanity defense during trial jury selection.
