Judge Invalidates Trump-Era Immigration Policies

A federal judge in Rhode Island invalidated several immigration policies from the Trump administration that halted asylum grants and processing of immigration benefits for individuals from 39 countries. The judge, John J. McConnell Jr., criticized these policies for placing lives on hold based on country of origin.

In a detailed 135-page opinion, Judge McConnell stated that the policies made it impossible for many eligible asylum seekers to remain in the country. These measures also blocked temporary work permits. He described the actions as fueled by anti-immigration sentiments and contrary to existing immigration laws.

Policies enacted by U.S. Citizenship and Immigration Services included a global pause on asylum applications and halted decisions on immigration applications for individuals from countries affected by the travel ban. This impacted people primarily from Africa and the Middle East, preventing them from obtaining green cards and other benefits.

The changes affected lawful permanent residents who have resided in the U.S. for years, delaying their naturalization applications. The judge’s decision requires the government to revert to normal processes to address over a million backlogged applications.

James Percival, general counsel for the Homeland Security Department, attributed the decision to opposition from the left, calling it “sabotage dressed in legal clothing.”
