Alabama authorities moved forward with plans to execute Jeffery Lee using lethal injection. This decision came hours after a nitrogen hypoxia execution was halted. The Alabama Attorney General’s office requested the state’s Supreme Court to issue a death warrant for Lee via lethal injection.
State attorneys clarified that the injunction only blocked the use of nitrogen hypoxia, not lethal injection. Jeffery Lee, photographed in custody, awaits further proceedings. He received a death sentence for a 1998 pawn shop robbery and double murder.
Lee’s legal team has not commented on recent developments. His attorneys must respond to the Supreme Court regarding the execution request. Meanwhile, Alabama Attorney General Steve Marshall reiterated his commitment to enforcing the death sentence.
The delay in executing Lee with nitrogen hypoxia followed the U.S. Supreme Court’s refusal to lift an injunction. The lower court found that the state’s nitrogen protocol breached the constitutional ban on cruel punishment. Despite this, the state can still use lethal injection or the electric chair.
Details from court documents indicated a planned nitrogen hypoxia execution at 6 p.m. for Lee. He has been on death row since a judicial override sentenced him to death, despite a jury’s recommendation for life imprisonment. Alabama banned judicial overrides in 2017.
Alabama continues to advocate for nitrogen gas as a humane execution method. Previous controversies surrounded lethal injection. Legal disputes over nitrogen hypoxia will proceed to trial in 2027.
