Supreme Court Upholds State Laws on Transgender Athletes

The Supreme Court delivered a divided decision on Tuesday, upholding state laws that bar transgender female athletes from participating in girls’ and women’s sports teams. This 6-to-3 ruling specifically addresses laws from West Virginia and Idaho. However, the verdict carries implications for 25 other states with similar restrictions. This impacts athletes participating in school and collegiate sports nationwide.

During the Trump administration, there was active support for state bans targeting transgender athletes in sports. President Trump instructed federal agencies to withdraw funding from schools permitting transgender athletes to compete in girls’ and women’s sports categories.

The cases generated significant public interest. Olympians and elite athletes closely followed the proceedings and submitted legal briefs supporting both sides of the argument. In March, the International Olympic Committee also barred transgender athletes from competing in the women’s category at the Olympics. This decision requires all participants in those events to undergo genetic testing. Similarly, last year, the N.C.A.A. announced a ban on trans women from competing in women’s sports.

At the center of the Supreme Court case were two challengers. Becky Pepper-Jackson, a high school student from West Virginia, and Lindsay Hecox, a college student from Idaho, contested their state laws. These laws mandate that participation in sports teams for girls must be based on “biological sex,” defined by a person’s sex at birth.

The ruling revealed a clear ideological division within the court. The conservative majority upheld the states’ ability to determine eligibility for women’s and girls’ sports using biological sex as a criterion.
