Judge Blocks Trump’s Challenge to Minnesota Sanctuary Policies

Understanding the Supremacy Clause

In his 56-page opinion, Tostrud dismissed all claims by the Justice Department against Minnesota, Minneapolis, St. Paul, and Hennepin County. His ruling specified that the challenged laws only regulate state and local officials.

They do not command the federal government or its contractors to act. They do not forbid the federal government or its contractors from acting. They do not control how the federal government or its contractors undertake their work. Rather, they regulate how state and local officials perform their duties.

According to Tostrud, accepting the administration’s position would conflict with the Tenth Amendment’s anti-commandeering doctrine.

Implications of the Ruling

This ruling represents a setback for the Trump administration’s efforts to invalidate sanctuary policies nationwide. The administration’s stance is that these policies interfere unlawfully with federal immigration enforcement.

Attorney Eric Wessan, from the Iowa Solicitor General’s Office, argued that Tostrud’s decision contradicts a previous Eighth Circuit ruling, suggesting the federal government has grounds to challenge state laws obstructing federal immigration enforcement.

Wessan further commented, “Judge Tostrud cited that opinion to explain that preemption is narrow. I think that his opinion is hard to square with the binding precedent.”

Debate Over State Cooperation

The Justice Department contended that Minnesota’s policies conflict with federal immigration statutes. They restrict local officers from honoring ICE requests, limit information sharing, and bar local officials from participating in enforcement efforts. But Tostrud clarified that refusal to cooperate does not amount to obstruction of federal enforcement.

Wessan stated the larger issue is the national immigration crisis, suggesting Minnesota should recognize federal efforts to address illegal immigration challenges, along with associated waste, fraud, and abuse.

Minnesota’s sanctuary policies have faced scrutiny, especially following Operation Metro Surge, an ICE initiative that increased federal law enforcement presence, sparked protests, and drew national attention.

The operation escalated after two U.S. citizens were shot by federal agents, adding pressure on Minnesota’s policies and resulting in administrative changes, with Tom Homan taking over after Kristi Noem’s removal.

Homan advocated for local cooperation, stressing reduced federal presence would require Minnesota officials’ collaboration with ICE.

“Cooperation with local authorities, especially jails and prisons, will give federal agents better access to people in the United States illegally,” Homan stated. “This would then lead to fewer federal law enforcement [agents] on Minnesota streets.”

The Trump administration persists in challenging sanctuary policies across several other states, continuing its legal battle.
