Debate Over Title IX and Women’s Sports
USA Today columnist Nancy Armour has raised concerns about the Heritage Foundation’s stance on Title IX. After facing criticism for her previous comments on Caitlin Clark, Armour highlighted a report from the think tank that suggests changes to the law.
The report, titled “Title IX’s Failed Experiment: Why Accommodating Sex Differences Beats Engineered Parity,” critiques the current interpretation of the 1972 federal civil rights law. This law is designed to prevent sex-based discrimination in educational activities receiving federal funding. Scott Yenor, a senior research fellow, argues that stricter enforcement has led to negative consequences for student athletes.
The Heritage Foundation claims Title IX has transitioned from an anti-discrimination tool into a force for feminist social engineering. “Title IX evolved from a seemingly modest anti-discrimination statute into a powerful engine of feminist social engineering, complete with proportionality mandates,” states the report. It argues for a reassessment that acknowledges natural and cultural differences between sexes, with a focus on further opportunities for sports typically dominated by women, like cheerleading.
Armour argues that the organization’s efforts threaten to undo women’s rights advancements made since the 1970s. She claims their goal is to enforce a conservative set of values that restricts women’s rights and promotes a narrow view of femininity.
In contrast, Scott Yenor from the Heritage Foundation advocates for reform rather than elimination. He suggests revising the law to emphasize opportunities in female-centric sports and reduce focus on proportional outcomes.
Amid these debates, Armour had previously faced backlash for comments on Caitlin Clark, an Indiana Fever star. Criticized for suggesting Clark endangered minority players through her behavior, Armour apologized for comparing Clark’s actions to the historical murder of Emmett Till, acknowledging the country’s history of racial violence.
