Shift towards Merit-Based Hiring
The Trump administration continues to emphasize reforming the federal hiring process, focusing on merit-based criteria over Diversity, Equity, and Inclusion (DEI) policies. Scott Kupor, the Director of the Office of Personnel Management (OPM), highlighted significant changes that prioritize skills and accountability.
These changes include eliminating self-attestation, implementing skills-based assessments, and enhancing accountability for underperforming employees. The reforms aim to improve performance within the federal workforce, which includes approximately 2.2 million employees.
Elimination of Decades-Old Guidelines
The OPM recently issued an interim rule that removes references to the 1978 Uniform Guidelines on Employee Selection Procedures. This decision follows a Justice Department legal opinion deeming these guidelines unconstitutional due to their encouragement of race-conscious employment practices.
This move is part of a wider campaign to shift federal hiring away from DEI policies towards a merit-based approach. It affects how federal agencies conduct hiring by removing guidance focused on “disparate impact,” which previously considered whether hiring practices led to unequal outcomes among racial groups. Critics argue that the old guidelines pressured employers to focus on racial outcomes over qualifications.
Commitment to Legal and Job-Related Standards
“Federal hiring should be based on merit, qualifications, and the ability to perform the job,” stated OPM Director Scott Kupor, explaining that the new rule aligns OPM’s regulations with legal guidance while maintaining robust, job-related standards.
The interim rule takes effect immediately but will be open for public comment for 60 days before a final decision is made on its permanence.
OPM’s Role and Further Reforms
As the federal government’s human resources agency, the OPM sets workforce policies for nearly 2 million civilian employees across executive branch agencies. These policies affect recruitment, hiring, promotion, and workforce management standards.
The Trump administration’s moves extend beyond eliminating DEI offices or diversity training, targeting the legal and regulatory foundations criticized for enabling DEI policies.
Impact on Broader DEI Initiatives
Since President Trump’s second term, the administration has also observed numerous colleges roll back DEI initiatives. They made policy changes concerning transgender athletic participation, parental rights, and merit-based admissions.
Federal DEI programs have been dismantled, DEI-related grants and contracts terminated, and schools warned of potential loss of federal funding over specific DEI practices.
