Senate GOP Push to Close Immigration Loophole Led by Britt

Senate Republicans are pushing to eliminate an immigration loophole they say has been exploited by the Biden administration. Senator Katie Britt from Alabama is spearheading this effort. The proposed legislation aims to prevent the release of detained illegal immigrants back into the U.S. if their home countries refuse to accept their return.

Britt’s bill, known as the Keeping Our Communities Safe Act, tackles a loophole resulting from a Supreme Court decision in 2001. The ruling allowed illegal immigrants to be released after six months if no country accepted them for deportation.

“We want to establish ways for these individuals to return to their countries,” Britt stated. “However, if a country won’t comply, that does not mean they should freely move within the U.S.”

The Supreme Court decision over two decades ago limited federal authority to detain illegal immigrants, permitting them to be released if after six months there is no belief of removal. The government then must present evidence that removal remains possible. If not, the detainee must be released under supervision.

The proposed bill modifies the Immigration and Nationality Act, a longstanding law from the 1950s that shapes U.S. immigration policies. It seeks to expand the Department of Homeland Security’s authority to detain illegal immigrants, deny bonds to those who pose risks, and limit bond availability unless they can prove they are not a flight risk or a danger to the community.

The bill proposes extending detention for those who threaten national security or have committed severe felonies. It has been circulating in Congress since 2011 and was previously attempted under the Biden administration.

So far, 11 Senate Republicans support as co-sponsors, including Senators Tom Cotton, Tommy Tuberville, Kevin Cramer, Mike Crapo, Ted Cruz, Deb Fischer, Cindy Hyde-Smith, Roger Marshall, Jim Risch, and Mike Rounds.

Tuberville emphasized, “Biden and Harris have allowed illegals into our country, burdening Americans. We must deport these criminals.”
