Trump Signs Executive Orders on Birthright Citizenship and Birth Tourism

President Donald Trump signed two executive orders on Thursday aimed at addressing birthright citizenship and birth tourism. He announced the changes following a Supreme Court decision Trump described as ‘very unfortunate.’

Trump remarked, ‘We are making adjustments because the situation is unfair. Businesses are capitalizing on birthright citizenship, which was not the original intent. It’s a disgrace we won’t allow.’ These changes aim to limit automatic citizenship as defined under the 14th Amendment.

White House representatives stated the new orders leverage existing executive and immigration authorities to restrict automatic citizenship eligibility. They target foreigners arriving in the U.S. primarily to give birth.

White House deputy chief of staff for policy Stephen Miller highlighted the first order expands the list of individuals deemed ineligible for birthright citizenship. This includes ‘alien enemies of the United States, members of foreign terrorist organizations, and individuals lobbying for foreign governments.’

The second order addresses birth tourism by banning practices for the first time in U.S. history. It aims to deny visas to those planning to give birth in the U.S. for automatic citizenship purposes, as well as those arranging such trips. Miller deemed birth tourism as ‘a fraud on the American system,’ citing Section 215(a) of the Immigration and Nationality Act.

Asked about enforcement, Trump stated, ‘We’re implementing substantial crackdowns. This allows us to enforce laws more effectively.’ He expressed confidence in the orders surviving legal challenges, saying, ‘I think it will.’

Will Scharf, White House staff secretary, indicated these orders specifically target organized birth tourism through measures like visa denials and law enforcement. He asserted they use ‘legally validated means’ aligning with Supreme Court views. Trump called the Supreme Court decision on the matter ‘very unfortunate.’
