The Trial Between Elon Musk and OpenAI: Debating AI’s Costs and Future
The legal battle between Elon Musk and OpenAI CEO Sam Altman highlighted the substantial resources and financial demands needed to develop artificial intelligence. This realization comes amid an AI-obsessed stock market fueling the expansion of chipmaking factories and data centers crucial for operating AI technologies. Evidence presented during the trial revealed that industry leaders were privately discussing these costs nearly a decade ago.
In a 2018 email to Altman and other OpenAI co-founders, Musk expressed concerns about the feasibility of competing with Google in AI development. He emphasized that billions of dollars per year were essential for success, underscoring the escalating financial needs of the industry. This sentiment influenced the transformation of OpenAI from a nonprofit committed to AI development for public benefit into a capitalistic entity valued at $852 billion.
As OpenAI and similar companies approach major Wall Street debuts, questions arise about whether commercial interests now solely drive AI’s future. Karan Girotra, a professor at Cornell Tech, noted that earlier investments in AI were speculative, but the current landscape is more predictable, with traditional investments supporting practical advancements. Girotra likened it to building a factory ahead of demand.

Musk’s lawsuit accused OpenAI of abandoning its charitable mission, alleging backroom deals among Altman and co-founders. OpenAI countered claims, stating that Musk had supported the formation of a for-profit structure and filed the lawsuit to undermine ChatGPT’s success as he developed xAI. However, the jury in Oakland, California dismissed the suit due to a missed statutory deadline, without evaluating the case’s merits.
The trial exposed internal disagreements reflective of current societal and political discussions surrounding AI’s impacts. Microsoft’s CTO Kevin Scott explained to jurors his company’s decision to invest billions in AI, despite initial skepticism about its potential. Microsoft’s involvement followed Musk’s departure from OpenAI’s board in 2018.
“It was before ChatGPT,” Scott stated, “and most people at Microsoft were skeptical about these claims materializing into reality.”
OpenAI convinced Microsoft of the need for expanded data and computing resources to enhance AI power. According to Scott, capital-intensive projects like constructing data centers with costly computers and networks were essential for OpenAI’s growth. This financial burden limited the nonprofit’s strategic options, underscoring the industry’s emphasis on profit.
OpenAI’s success in developing an AI system capable of defeating pro Dota 2 players marked a turning point, although it garnered less global recognition than anticipated. Altman described the event as pivotal internally, demonstrating the company’s technological capability using reinforcement learning for complex tasks. The victory prompted discussions about transitioning OpenAI into a for-profit structure to secure necessary funding.
Altman recalled Musk’s reaction to the Dota win. “He was impressed,” Altman said, highlighting Musk’s subsequent push to pursue greater capital investment. For co-founder Ilya Sutskever, this achievement highlighted the necessity of significant computing power, akin to the functionality of a human brain.
“The realization is that to make progress in AI, you need a big computer,” Sutskever told jurors. “And you need the big computer because the brain is a big computer.”
The internal struggle between leaders grew, with Musk advocating for OpenAI’s integration into Tesla, while other leaders resisted. Eventually, Musk departed from OpenAI, cementing the ongoing conflict over AI development strategy.
