Former CIA Director John Brennan has been subpoenaed to testify before a grand jury in Florida. This stems from a Justice Department investigation into whether former officials conspired against President Donald Trump. Brennan is also being scrutinized for potentially making false statements before Congress, according to his lawyer, Ken Wainstein.
Request for Record Preservation
Wainstein revealed the subpoena while seeking a court order for the Justice Department to preserve all investigation records. He termed these documents a “fertile source” for information and stressed their importance for Brennan’s defense. He argued that the prosecution of Brennan might be unconstitutionally vindictive and selective.
“I’ve never even conceived of a situation like this where the Justice Department is blatantly trying to frame somebody,” Wainstein stated.
He pointed to concerns such as “judge-shopping” and directives by Trump to target perceived enemies, including Brennan. Wainstein claimed there were resignations and replacements among prosecutors who had expressed doubts.
Details of the Subpoena
The subpoena requires Brennan to appear on October 15 in Fort Pierce, Florida. This location is under the jurisdiction of Judge Aileen Cannon, appointed by Trump. In 2024, Cannon dismissed a case against Trump regarding classified documents at Mar-a-Lago.
Brennan’s subpoena is part of a broader investigation into government officials who probed Trump, including his actions related to Russian election interference in 2016. It is seen as exploring whether these officials aimed to deprive Trump of civil rights. Brennan is also under investigation for allegedly lying to Congress about a U.S. intelligence report on Russian interference. However, Brennan and his legal team have called this charge untrue.
Subpoenas for testimony before the grand jury in the false statements case were issued last spring. These were later replaced with voluntary interviews. Wainstein believes Brennan is at risk of indictment due to the administration’s actions against him.
Resignation and Investigation Challenges
The subpoena coincided with the resignation of Joe diGenova, the prosecutor leading the “grand conspiracy” investigation. He left amid frustration from the Justice Department and the White House over the probe’s pace. DiGenova has stated there is sufficient evidence for prosecution, but the process cannot be rushed.
Kurt Olsen, a lawyer previously involved in promoting Trump’s unsubstantiated claims about the 2020 election, is a member of the investigative team. Brennan’s defense is seeking communications that might show Trump or White House directives to pursue Brennan, citing a pattern of record preservation failures by the Trump administration.
The Justice Department has labeled Wainstein’s request as premature and speculative, pointing out that Brennan is not a criminal defendant and may not be charged. Federal Judge Jia Cobb has yet to make a decision on the request.
