An intense legal dispute erupted in Plymouth, Massachusetts, following the Lindsay Clancy mistrial. Defense attorney Kevin Reddington and juror Michael Desronvil’s lawyer, Edward Paltzik, have been exchanging contentious remarks.
Reddington criticized Paltzik for public comments, urging him to focus on courtroom arguments rather than media appearances. Paltzik accused Reddington of filing improper motions, threatening the U.S. Constitution, particularly the Sixth Amendment.
Reddington emphasized the legitimacy of his actions, saying, “Every motion filed is legitimate, based on sound law, facts, jury questions. I’m representing Lindsay appropriately.”
Paltzik has been vocal on social media and in interviews, attacking Clancy’s defense. In one instance, he suggested Clancy deserves execution despite no conviction and Massachusetts not enforcing the death penalty.
Desronvil, the sole juror holding out, made headlines after eleven other jurors preferred a not guilty verdict by reason of mental disease. They agreed with Reddington’s defense claiming Clancy suffered postpartum psychosis.
Reddington described Desronvil as “the obstructionist juror,” frustrated by the mistrial outcome.
Reddington filed a motion for a ‘limited inquiry’ into Desronvil, seeking background checks and records that might clarify the juror’s actions.
Meanwhile, Clancy’s additional attorney, Martin Weinberg, requested dismissal on double jeopardy grounds after the judge overruled a defense objection at trial. Weinberg also called for investigation into the juror’s alleged disregard for the law and judge’s instructions.
Judge William Sullivan declared a mistrial due to jury deadlock after a week of deliberations. Clancy is set to appear in court, facing several defense motions. Prosecutors might pursue a retrial or plea deal regarding the grim case.
On January 24, 2023, Clancy committed a horrific act, killing her three children in their Duxbury home, followed by a suicide attempt that left her partly paralyzed.
Legal motions continue, highlighting intense scrutiny of the trial’s process and results.
