Court documents reveal he engaged in fraudulent real estate and gold acquisitions in Florida, valued at over $40 million.
Rush fabricated a ‘highly classified’ government program to acquire luxury properties in South Florida for personal resale. Additionally, he established a fictitious ‘sensitive government activity’ to procure hundreds of gold bars. His schemes resulted in approximately $194 million in federal government losses, including over $1.8 million for personal chartered flights authorized at government expense.
Investigators found that Rush disclosed the identity of a secret U.S. government source to a foreign official. The identity of the foreign government remains unspecified in court documents. Prosecutors also criticized Rush for lying about his military and academic credentials, as well as his fabricated program, falsely claiming high-level authorization.
Rush used his legitimate government authority and manufactured personal bona fides to create confidence in his directions.
Rush, 49, pled guilty to wire fraud, facing a maximum sentence of 20 years. Sentencing is set for January 28 in Alexandria, Virginia. Court records reveal that he previously attempted to illicitly release $100 million from a government contract. He directed the transfer of roughly $145 million to a holding company he established, then used those funds to purchase four luxury properties in Florida.
Investigations showed Rush hid about $46 million in government-owned gold bars at his Virginia residence. He falsely claimed military leave compensation following his 2015 discharge from the Navy. The Justice Department and CIA leadership condemned Rush’s abuse of authority. CIA Director John Ratcliffe stated that the agency notified the FBI after internal investigations.
David Rush abused his position and betrayed the public trust and should be held fully accountable for his actions.
Authorities say Rush lied on job applications about his education and military service, including false claims of being a Navy pilot and holding degrees from Clemson University and Rensselaer Polytechnic Institute. The FBI affidavit shows Rush enlisted in the Navy in 1997 and was discharged as a lieutenant from the U.S. Navy Reserve in 2015.
Rush was apprehended after authorities discovered nearly 300 gold bars, $2 million in cash, and 35 luxury watches at his home. He remains in custody without bond following a previous court appearance. During a June hearing, defense attorney Jessica Carmichael stated that the gold bars were not initially part of the charges, describing them as “basically a nonissue.” She claimed Rush kept them securely locked in his basement and never asserted ownership.
Carmichael refrained from commenting on the guilty plea following Tuesday’s hearing.
