Proposed Legislation to Replace DHS
House Democrat Delia Ramirez of Illinois has introduced a bill to abolish the Department of Homeland Security (DHS) and establish a new department focusing on community safety. This move comes closely ahead of an election where immigration policy holds significant voter influence.
The proposal, called the “Reimagining Safety Act,” aims to dismantle DHS, originally set up post-9/11. Speaking to Newsweek, Ramirez’s team affirmed essential functions like FEMA and TSA will continue under new departments, with civil immigration managed by the Department of Justice.
Criticism and Impact
Ramirez has been outspoken against the Trump administration’s immigration strategies, which faced criticism from Democrats nationwide. Her comprehensive plan might face scrutiny during the upcoming midterm elections.
Adam Klein, a former senior DHS official, discusses the reformative timing of the proposal. He emphasizes reviewing DHS operations related to immigration enforcement, civil liberties, and more. Klein raises concerns about maintaining operational duties like border security and counterterrorism if agencies are dismantled or moved.
“Eliminating or relocating agencies doesn’t eliminate the government’s responsibilities for border security, immigration enforcement, disaster response, cybersecurity, or counterterrorism.”
– Adam Klein
Details of the Bill
Ramirez’s bill advocates for a DHS dismantlement after 25 years, including scrapping ICE and releasing detained immigrants within six months. It seeks to repeal immigration detention laws, end detention facility contracts, and stop spending on monitoring programs, including ICE’s ankle monitor operations.
Plans include halting border wall construction and terminating Border Patrol’s surveillance program. Agencies, like FEMA and CISA, will join the new Department of Community Safety, while TSA and the U.S. Coast Guard move to the Department of Transportation. Treasury will address CBP’s customs duties, as the Department of Justice oversees immigration enforcement.
CBP border facilities would become welcome centers for asylum seekers, helping them connect with social workers, healthcare providers, and interpreters.
A DHS spokesperson critiques Ramirez’s bill, asserting the vital role of ICE agents and expressing concern over rising assaults as rhetoric continues to vilify law enforcement.
The Timing of Legislative Proposal
The proposal emerges as Republicans strongly campaign on border security and immigration issues. Analysts highlight immigration as a core issue for the GOP, while Democrats face challenges achieving consensus.
President Trump’s reelection in 2024, heavily influenced by immigration concerns, faces fluctuation amidst federal agent-citizen clashes and arrests of immigrants without criminal records. Shifts occur as Republicans witness changing sentiments from their constituents over immigration arrests.
Support for the Legislation
- Rashida Tlaib (Michigan)
- Adelita Grijalva (Arizona)
- Jim McGovern (Massachusetts)
Various advocacy groups support the legislation, including National Nurses United, Center for Constitutional Rights, and others.
Regardless of the bill’s legislative progress, it fuels debate over immigration and border security, as parties vie for Congressional control.
