A report from the Department of Homeland Security (DHS) indicates that 75% of all murders in the county are perpetrated by illegal immigrants. This data has fueled a contentious debate surrounding Fairfax County’s sanctuary city policies and their effect on public safety.
Details of Recent Criminal Case
U.S. Immigration and Customs Enforcement (ICE) recently apprehended Oscar Evaristo Nunez, an illegal immigrant from Honduras, involved in multiple child sex crime charges. Initially arrested on August 27, 2025, Nunez faced charges such as aggravated sexual battery involving children and illegal filming of a minor, according to DHS. Following his arrest, ICE lodged a detainer at the Fairfax County Adult Detention Center, but he was released without notification to the agency.
“Another criminal illegal alien has been taken off the streets by the brave men and women of ICE with no help from sanctuary politicians in Fairfax County,” said DHS Secretary Markwayne Mullin.
Political and Policy Implications
This case has sparked significant debate between the Trump administration and Virginia officials about cooperation with federal immigration enforcement. Virginia’s Governor, Spanberger, who took office in January 2026, was not governor when Nunez was initially arrested. She has instituted policies that move Virginia away from participating in federal immigration enforcement. This includes terminating agreements with ICE under the federal 287(g) program.
Fairfax County representatives have not responded to inquiries on this matter. Nunez remains in ICE custody as he awaits immigration proceedings.
Oscar Evaristo Nunez had entered the United States illegally through Arizona in September 2003, according to the DHS.
