Disney Sues FCC Over ABC Stations’ License Renewal

Disney has filed a lawsuit against the Federal Communications Commission (FCC), aiming to halt the agency’s early renewal process for ABC station licenses. This legal action claims violations of the First Amendment. FCC Chairman Brendan Carr advocated for the early renewal of licenses for eight ABC-owned stations in April. Originally, these licenses were scheduled for renewal between 2028 and 2031. However, the FCC expedited the process due to ongoing issues between the Trump administration and Jimmy Kimmel, an ABC late-night host.
As part of this process, the eight stations must prove they have operated in the public interest, examining Disney’s diversity, equity, and inclusion (DEI) practices. Disney argues that the Trump administration has targeted ABC because it disapproves of ABC’s broadcasts. ABC’s legal complaint cites increasing attacks on its speech and content, claiming the administration demands ABC lose its broadcast licenses due to its content.
The complaint details the FCC’s actions against ABC as using regulatory powers to stifle free speech. Facing these challenges, Disney seeks judicial intervention against what it views as retaliation for protected speech under the First Amendment. ABC plans to request a temporary restraining order and preliminary injunction against the FCC’s actions.
An excerpt from ABC’s motion expresses concern about the federal government’s use of regulatory powers to penalize media entities over editorial content, asserting that the First Amendment prohibits such actions. The FCC has not yet responded to these claims. Concurrently, the FCC has begun an investigation into ABC’s daytime show “The View” and has criticized Disney for not broadcasting Trump’s primetime address.
Despite objections, Disney states it has cooperated with FCC inquiries by submitting over 13,000 pages of documents. Disney’s legal team stresses the undue pressure on ABC from the administration’s alleged retaliatory measures, which impact the broader media industry.
The stations involved in the FCC’s renewal demand include KFSN-TV in Fresno, KABC-TV in Los Angeles, KGO-TV in San Francisco, WLS-TV in Chicago, WABC-TV in New York, WTVD in Durham, WPVI-TV in Philadelphia, and KTRK-TV in Houston. The proceedings create a significant threat of extended litigation and regulatory challenges for these broadcasters, according to Disney.
An FCC representative previously stated that broadcasters have been supported financially through free use of airwaves and are required to operate in the public interest. They must avoid partisan interests and discrimination in DEI practices. The FCC reaffirmed its commitment to holding broadcasters accountable under the law, regardless of misinformation campaigns.
