Idaho Judge Outlines Procedure for Bryan Kohberger’s Plea Withdrawal Attempt

In Boise, Idaho, a judge has outlined the procedure for Bryan Kohberger’s efforts to withdraw his guilty plea in the murders of four University of Idaho students. Fourth District Judge Steven Hippler, who sentenced Kohberger to life in prison without parole, specified the guidelines for the case in a written order.
Kohberger pleaded guilty to the murders, and in exchange, prosecutors agreed not to seek the death penalty. He has filed a petition asking to revoke his plea, claiming manipulation by his attorneys. Kohberger cited promises of better prison conditions and fears about life on death row as influencing factors. He stated his lawyers did not disclose or review evidence potentially favorable to his case during plea discussions.
Judge Hippler did not grant Kohberger a hearing immediately, scheduling a date for next June, should an evidentiary hearing become necessary. Kohberger, 31, is serving four consecutive life sentences for the murders of Kaylee Goncalves, Ethan Chapin, Xana Kernodle, and Madison Mogen in 2022 near the Moscow, Idaho, campus.
The judge has emphasized that all new evidence must meet a strict legal standard according to the Idaho Rules of Court Procedure. These procedures dictate what evidence is admissible and how objections to evidence should be handled. Non-compliance could lead to sanctions.
Both sides must disclose any potential witnesses, including experts, by February. Hippler has scheduled a status conference for next June.
