Justice Department Moves to Dismiss Charges Against Jan. 6 Rioters

The Justice Department has shifted its approach to the investigation into the Capitol attack on January 6, 2021. Recent actions align closely with President Trump’s efforts to downplay the events of that day.

On a recent Friday evening, federal prosecutors in Washington made a significant move. They filed motions to dismiss some of the most serious criminal cases from January 6, targeting leaders and members of far-right groups previously convicted of seditious conspiracy.

Additionally, a Justice Department social media account announced a major change. The department is removing online news releases related to the indictments filed against January 6 participants.

The investigation into the Capitol riot from 2021 to 2025 was the largest criminal inquiry in the department’s history. It led to charges against nearly 1,600 individuals. President Trump, upon starting his second term, granted clemency to all defendants. Since then, the department has been working to reverse its broad efforts to hold rioters accountable for disrupting the presidential power transition after the 2020 election.

Senior officials within the department have been involved in creating a $1.8 billion fund. This fund aims to compensate Trump allies who feel wronged by previous Democratic administrations in the courts. Many January 6 rioters have welcomed this initiative and plan to claim payouts.

The motions to dismiss the sedition cases against members of the Proud Boys and Oath Keepers further clear away vestiges of significant criminal proceedings from the Capitol attack. Although these individuals received pardons or commuted sentences from President Trump, the complete dismissal of their charges would be a symbolic win. It would permit veterans among them to regain military benefits lost after their convictions.
