Nike Faces Civil Rights Investigation Over Diversity Practices
Nike has been a prominent advocate for diversity, reflected in its advertising and workforce efforts. However, this commitment attracted scrutiny from the Equal Employment Opportunity Commission (E.E.O.C.), led by Andrea Lucas. Lucas, appointed by President Trump during his first term, raised concerns that Nike’s approach may have discriminated against white employees and applicants.
In May 2024, Lucas authored a memo claiming that Nike systematically discriminated against white individuals, questioning the influence of race on the company’s employment decisions. The memo suggested that Nike violated federal law if race impacted employment decisions, including training programs. Lucas emphasized the urgency to prevent future unlawful discrimination.
Lucas filed a charge that initiated a civil-rights investigation into Nike’s practices. Her focus on Nike provided guidance for similar investigations as she ascended to the role of E.E.O.C. chair. Historically, the E.E.O.C. investigated employers whose hiring and promotions might unfairly consider race, sex, disability, or national origin. Employers seeking to diversify hiring pools found support following periods of discrimination against qualified candidates.
Nike’s stance on diversity put it at the center of Lucas’s investigation, highlighting the complex balance between fostering inclusivity and adhering to legal standards. As the investigation unfolds, Nike faces challenges reconciling its diversity objectives with compliance obligations.
