Judge Allows Relaxed Constitutional Rights for Alleged Charlie Kirk Killer

The judge presiding over the case of Tyler Robinson, accused of killing conservative podcaster Charlie Kirk, has signaled a more flexible application of constitutional rights during preliminary hearings. This decision by Judge Tony Graf Jr. comes as the court prepares for the trial proceedings.

The judge’s statement was made in response to discussions about which evidence could be presented during the trial. Robinson, 23, opposed the use of hearsay by the prosecution for establishing probable cause, and sought to compel his former roommate to testify in person. Judge Graf noted that the Utah state constitution permits hearsay evidence and acknowledged the possibility of a ‘relaxed application’ of certain rights at this stage of the legal process.

The charges against Robinson stem from an incident on September 10, 2025, when Kirk was shot during an event at Utah Valley University. Robinson has not yet entered a plea on the charge of aggravated murder.

Robinson had requested that his former roommate testify live during the preliminary hearing. According to prosecutors, Robinson had texted the roommate, expressing intentions to target Kirk due to his views. The defense argued for live testimony to allow Robinson to challenge witness credibility directly.

Judge Graf denied this request, clarifying that the opportunity to question witnesses would arise later in the trial. Furthermore, Graf refused the defense’s plea to bar hearsay evidence, explaining that a preliminary hearing is not a final judgment on guilt or innocence.

Additionally, Graf deferred a decision on whether prosecutors might face sanctions regarding their media statements about bullet fragments found on Kirk’s body. A ruling on this matter may be issued by Friday.

Upcoming Legal Proceedings

Robinson’s preliminary hearing is scheduled for July, with his full trial set to occur at an undetermined future date. Conviction in this case could lead to the death penalty, which the defense is actively seeking to avoid.
