Sessions, Trump’s first attorney general, issued a 2017 memo. It barred the Justice Department from settling lawsuits by directing payments to third-party groups. The memo aimed to ensure settlement funds compensated only the direct victims of a case.

This directive responded to practices during the Obama administration. At that time, the Justice Department negotiated settlements involving banks sued for lending practices contributing to the 2008 financial crisis. The settlements included donations to groups like the National Council of La Raza and NeighborWorks. These organizations provided legal aid and community development in affected neighborhoods. Republicans criticized this as funneling money to groups favored by Democrats without Congress’s approval.

In contrast, the Trump administration recently announced a $1.776 billion fund. This fund circumvents Congress and pays off Trump’s allies. Additionally, Trump and his family agreed to drop a $10 billion lawsuit against the IRS over leaked tax information. Included in this agreement, Trump receives immunity from any tax investigations into him, his family, or businesses—an explicit condition in the document signed by acting attorney general Todd Blanche.

David French highlighted the disparity between the Obama-era initiative and Trump’s fund. He described Trump’s approach as a slush fund under Trump’s total control. This fund’s massive size, $1.776 billion, holds the potential to make many MAGA supporters wealthy.
