Federal Lawyers Transitioning to Democratic States Amid Trump Administration Tensions

As tensions rise during President Trump’s second term, a significant number of federal attorneys are transitioning to Democratic state attorneys general offices. This shift coincides with blue states ramping up their legal opposition to Trump’s agenda. Data from the New York Times indicates that over 10,000 federal lawyers left their positions in 2025 alone, representing about one-fifth of all federal attorneys.
A review by Fox News Digital identified more than 100 attorneys who moved from federal roles to Democratic state offices. These attorneys are engaging in cases challenging the Trump administration. The identification process involved public LinkedIn profiles, state staff directories, official statements, and court filings.
Oregon Attorney General Dan Rayfield has mentioned that numerous skilled lawyers from the U.S. Department of Justice are now serving at the state level. They are influencing various legal areas, including consumer protection, criminal justice, and environmental protection.
“Oregon DOJ is a destination for some of the most talented public servants,” Rayfield stated.
Court filings show that former federal attorneys are now actively challenging Trump administration policies. Cases include Massachusetts opposing restrictions on transgender healthcare, California challenging research grant terminations, and efforts to rein in National Guard deployments.
Collaboration among Democratic attorneys general is a strategic part of their resistance against Trump’s policies. They meet regularly to coordinate legal actions and maintain public engagement.
Massachusetts Attorney General Andrea Joy Campbell emphasized the ongoing protection of rights and rule of law.
“We can’t take our sight off of that,” Campbell noted.
The decision of many federal lawyers to join Democratic state offices reflects a shift in expertise and experience. Notably, those moving often held career federal positions, bringing years of service and knowledge with them. For example, a former DOJ legal intern, now a senior attorney general in Colorado, is working against federal grant disputes.
The Trump administration denies any impact on its efficiency, citing achievements such as indicting more criminals and reducing the murder rate. A DOJ spokeswoman contends that the administration operates efficiently despite the departures.
“These achievements are nothing short of astonishing,” she said.
Despite losing talents, agencies are actively hiring new attorneys, with over 3,200 hired since January 2025. This recruitment aims to align ideologically with the administration’s goals.
Federal lawyers leaving service mainly come from key agencies like the DOJ, Department of Education, and EPA. States such as California, Maryland, New York, and Colorado are common destinations for these lawyers.
As the Trump administration continues to adjust its workforce, the White House asserts that departures have streamlined operations. President Trump believes this restructuring attracts dedicated attorneys aligned with his mission.
