During a recent House Oversight Committee hearing led by Democratic members, the fatal shootings related to Department of Homeland Security (DHS) agents during the Trump administration were examined. Among the cases discussed was the death of Joan Sebastian Durán Guerrero in Biddeford, Maine, in July.
Attorney Sean P. Murphy, representing Guerrero’s family, revealed that Guerrero’s daughter Dulce’s car seat could not be returned as evidence because it was struck by a bullet fired by a federal agent. Guerrero’s wife, Carolina, had sought clarification from the Maine Attorney General’s Office regarding the car seat’s status.
Because just like bullets fired by a federal agent struck and killed Joan Sebastian, a bullet fired by a federal agent pierced Dulce’s car seat,Murphy stated. Though initial reports indicated Dulce was in the car with her father during the shooting, she was not.
The Maine Attorney General is investigating ICE’s use of deadly force in the state. This investigation follows another incident in Houston where Lorenzo Salgado Araujo was shot dead. The committee heard testimonies from the relatives of the victims, including Renee Nicole Good and Ruben Ray Martinez. They spoke of their experiences losing loved ones to federal shootings.
Murphy emphasized the unique grief experienced by families affected by such incidents, describing it as a membership no one would choose.
Details of the Biddeford ICE Shooting
Guerrero, authorized to work in the U.S., was shot by an ICE officer while driving from his home. Despite agents conducting enforcement operations, he was reportedly not the intended target. Witnesses recalled hearing gunshots and agents’ shouts on the street. Attempts were made to provide Guerrero with medical care, but he died at the scene.
ICE did not allege that Guerrero attempted to weaponize his vehicle. Instead, the agency stated that he was attempting to flee.
Institution of an Independent Investigation
Maine’s Attorney General, Aaron M. Frey, announced an independent probe into the shooting, which falls under state jurisdiction. Maine law stipulates Frey’s office’s exclusive responsibility to investigate homicides and federal agents’ use of deadly force.
Murphy noted that this type of investigation into ICE shootings is not observed elsewhere in the country.
Testimonies Highlight Personal Losses
Families recounted emotional stories about losing relatives to ICE shootings during the hearing. Martinez’s mother, Rachel Reyes, shared her son’s experience in South Padre Island, highlighting ICE’s involvement.
His death reflects a pattern of callousness and power imbalance,Reyes remarked, emphasizing the need for concern over rights violations.
Donna Ganger, Good’s mother, expressed her hopes for justice and accountability. Good was shot by an ICE agent in Minneapolis, sparking widespread protests. Ganger stressed the silence left by her daughter’s unfulfilled potential.
Pretti was killed during protests by a Customs and Border Protection (CBP) officer. His friend Stella Carlson shared how Pretti attempted to aid a civilian before he was shot.
Salgado Araujo’s sons also spoke, describing their family’s anguish since their father’s death.
The hearing prompted strong criticism from Democratic representatives, who emphasized accountability for those responsible for these incidents.
