Judge Warns Trump Over BBC Lawsuit Documentation
A federal judge has issued a warning to Donald Trump regarding his $10 billion lawsuit against the BBC. The judge cautioned that the lawsuit could be dismissed if Trump’s legal team fails to provide more relevant documents or evidence demonstrating their search efforts.
Trump’s attorneys had until October 21 to ensure the accuracy of their written answers and to supply any relevant, undisputed documents. This is part of the discovery process in Trump’s lawsuit, where he claims the BBC defamed him through editing his speech related to the U.S. Capitol riot in 2021. Though the BBC has apologized for the edit, it denies defamation.
The response “consisted of a mere twenty documents, all of which were previously produced by Defendant and/or retrieved from the internet in the days leading to the production date,” Magistrate Judge Enjolique A. Lett noted.
Judge Lett highlighted that Trump’s team admitted to not producing a log that identifies documents withheld due to privilege claims.
“Given the nature of the requests, the paucity of the production, and the steps counsel undertook to ensure that all responsive documents were collected, the Court has concerns about whether an adequate search for all responsive documentation occurred,” Lett expressed.
Judge Lett has ordered Trump’s legal team to submit a privilege log by November 5 and any remaining responsive documents that are not in dispute by November 23.
Failure to comply with this order may result in sanctions, including but not limited to, dismissal of this action for failure to prosecute this case,” Lett warned.
This situation is ongoing, and further developments are anticipated.
