Trump Seeks to Dismiss NAACP Pollution Lawsuit Against xAI

In April, the civil rights organization NAACP filed a lawsuit against xAI, alleging that the company failed to obtain an air pollution permit for its Colossus Gas Plant. This facility powers the Colossus 2 data center, which subsequently powers the AI chatbot Grok. On Monday, the Justice Department submitted a filing asking the court to dismiss the case, stating that the enforcement of the Clean Air Act should be at the discretion of the United States.
The Trump administration emphasized Grok’s importance for national security, naming it as one of the four AI models that can support national security applications and one of the three models capable of facilitating mission-critical operations on Secret and Top-Secret classified networks.
The NAACP’s lawsuit claims that xAI’s plant, composed of 27 gas turbines, emits substantial pollution that contributes to asthma, respiratory diseases, heart problems, and certain cancers. Moreover, the surrounding communities reportedly have a disproportionately high Black population, raising environmental justice concerns.
