Amazon and Major Retailers Face Cease-and-Desist Over E-Bikes in NYC

New York City’s Mayor Zohran Mamdani has issued cease-and-desist letters to 40 significant retailers, including Amazon, Wayfair, Walmart, and Target, concerning the sale of certain motorized scooters and e-bikes. These retailers are urged to halt the sale of these devices to city residents and businesses. If they fail to comply by August 18, they may incur fines of $2,000.

The ban on these motorized scooters and e-bikes is due to some models exceeding legal speed and wattage limits. Additionally, some mopeds lack proper Vehicle Identification Numbers (VINs). The speed limit for e-bikes in New York City stands at 15 mph, while the maximum permissible speed varies from 20 to 25 mph, depending on the bike model. Scooters are restricted to a weight of 100 pounds and a speed of no more than 20 mph.

Mike Flynn, Commissioner of the Department of Transportation, emphasized, “Let’s be clear, these are motorcycles being marketed to New Yorkers as bicycles.” The actions follow a tragic incident involving 17-year-old Gabriel Nacato, who was struck by an SUV while riding an e-bike in Lower Manhattan. His e-bike could reach speeds of over 30 mph, which is unsuitable for bike lanes, Mamdani noted.

A representative from Amazon stated that the company is investigating the involved products and expressed willingness to cooperate with the mayor and City Council to address the issue. They highlighted that “Safety is a top priority and we require e-bikes sold in our store to meet applicable safety standards and Amazon policies.” Target has not yet provided a statement on the situation.

It’s crucial for retailers to adhere to these regulations to ensure public safety and compliance with city laws.
