In a tragic incident, the family of Kirk Foyle, a 64-year-old Texas father of four, has filed a lawsuit after he was fatally crushed by a falling tree at Green Mesquite BBQ in Austin. The incident occurred on May 19 while Foyle was dining on the outdoor patio, as storms passed through the area. The tree, identified as a ‘Widow Maker,’ was positioned over the patio and collapsed with tragic results.
Lawsuit Details and Allegations
The lawsuit claims negligence on the part of Green Mesquite BBQ and neighboring business Aspen Hatter, where parts of the tree were located. It alleges the businesses failed to inspect, maintain, or properly remove the diseased and decaying tree, which posed a visible danger. The complaint states the tree’s dangerous condition should have been known to the defendants through reasonable care and inspection efforts.
The legal filing also notes that, contrary to the restaurant’s claim of a lightning strike, the lack of maintenance caused the tree’s demise. The lawsuit further points out that property owners refinanced the property with a $960,000 deed of trust shortly after Foyle’s death. The family seeks at least $1,000,000 in damages for gross negligence, mental anguish, and legal expenses.
