Attorney Discusses Complex Extradition Case of Texas Man

Dick DeGuerin, a seasoned criminal attorney with 60 years of experience, is currently representing Lee Gilley. Gilley, aged 39, is accused of murdering his wife, Christa Bauer Gilley, who was nine months pregnant, in Houston in October 2024. Prosecutors claim he killed her inside their home.
The case took a turn when Gilley allegedly cut off his ankle monitor and fled to Italy in May, just weeks before his trial. DeGuerin said, “I’ve had clients skip bond before, though rarely, but never like this.”
Gilley was apprehended by Italian authorities upon arrival and has remained in custody since. The United States attempted his extradition, but the process halted when Italian courts denied it due to Texas law, which includes the death penalty as a potential punishment for capital murder.
“The Italian courts will not extradite if the death penalty is on the table,” DeGuerin explained.
On September 18, Harris County prosecutors removed the death penalty option after Italy insisted on written guarantees. Gilley’s defense attorney, Ed McClees, supports this removal, indicating Italy’s demand for assurances.
Despite this, extradition has not progressed further. Italian courts are concerned that a judge might still impose the death penalty, even though, as per DeGuerin, this decision lies solely with a jury. Concerns also exist over the possibility of life imprisonment without parole being imposed, which could lead Italy to refuse extradition.
The U.S. must reconcile these concerns by September 30, after which a status conference will be held on October 7 to evaluate Italy’s position on extradition. DeGuerin remains firm in his client’s defense, stating, “We’ve maintained from the very beginning that he is not guilty and he did not kill his wife.”
