The catalyst was a malfunctioning storage tank, containing flammable methyl methacrylate (MMA), which overheated. This incident led to evacuation orders in several Orange County cities.
State of Emergency Declared
Governor Gavin Newsom announced a state of emergency in response to the incident in Orange County. The situation escalated when a crack formed in the storage tank relieving some pressure. This mitigation prevented a disastrous explosion and allowed most residents to return home safely.
The Trespass Claim
A key aspect of the plaintiffs’ case is the ‘trespass’ claim. It argues that the chemical vapors and odors that entered the community constituted an invasion of their property. The lawsuit seeks unspecified compensation for emotional distress, temporary loss of property use, and decreased property value due to chemical exposure stigma.
Mass Evacuation
More than 50,000 residents in areas including Anaheim, Buena Park, Cypress, and Garden Grove had to evacuate. GKN Aerospace has been located in Garden Grove since 1966. Even during the emergency, Disneyland remained open as the evacuation zone shrunk around the chemical tank scare.

The lawsuit highlights GKN’s history of regulatory issues, particularly a 2025 settlement involving air quality violations that resulted in a significant civil penalty. Plaintiffs assert that the company was aware of the risks and failed to implement necessary safety measures.
Health Risks from MMA
According to the Environmental Protection Agency, exposure to MMA can lead to serious respiratory problems and irritation of the skin, eyes, and throat. This adds gravity to the lawsuit filed by residents concerned about the long-term effects of the chemical exposure.

The Orange County Register reported at least 44 lawsuits related to this incident. The involved parties emphasize the overlooked risks of operating with hazardous materials by GKN Aerospace.
