Colorado Court Reverses Homicide Convictions in Elijah McClain Case

A Colorado court has overturned the homicide convictions of two paramedics in connection with the ketamine overdose death of Elijah McClain. The court has ordered new trials for Jeremy Cooper and Peter Cichuniec of Aurora Fire Rescue, who were involved in the 2019 incident where McClain was forcibly restrained by police.

The appeals court decided on Thursday, reversing the previous 2023 jury guilty verdict for the paramedics on charges of criminally negligent homicide. The initial trial, held in a state district court, lasted several weeks and concluded with the convictions of Cooper and Cichuniec.

Jeremy Cooper received a sentence of 14 months in jail, along with work release and probation, instead of prison time. Peter Cichuniec, found guilty on an additional count of felony assault, faced a harsher sentence. The appeals court upheld Cichuniec’s assault conviction.

The appellate judges highlighted shortcomings in the instructions provided to jurors regarding the criminally negligent homicide charges, affecting the fairness of the deliberations.
