Debate Over Sanctuary Jurisdictions and Immigrant Detainment

A New York City congressman, Rep. Daniel Goldman, faced criticism from Republicans and the Department of Homeland Security (DHS) after asserting that sanctuary jurisdictions hand over removable criminal illegal immigrants to federal authorities once they complete their sentences.

Goldman, a Democrat representing Lower Manhattan and Downtown Brooklyn, made these remarks during a discussion about a proposed bill to formalize President Donald Trump’s border security measures.

Republican Opposition

Republicans, including Reps. Darrell Issa and Tom McClintock from California, challenged Goldman’s statement. During the discussion, Issa requested Goldman to provide a case where a criminal convict was not turned over to federal authorities after serving a sentence for a removable offense. Goldman expressed confidence that such examples would be rare.

However, skepticism arose following his comments. Rep. Brad Knott, a Republican from North Carolina, argued that in his state, sanctuary jurisdictions often do not follow that practice. Highlighting this, he mentioned that a law was passed at the state level to counter such discretionary decisions.

DHS Response

The DHS disputed Goldman’s claim, referencing statistics from New York. According to the DHS, since January, New York has released 6,947 criminally convicted illegal immigrants due to ignoring ICE detainers. Crimes include 29 homicides, 2,509 assaults, and 392 dangerous drug offenses. The DHS emphasized the need for public safety over political gains.

Historical Context and Critique

Goldman also responded to Issa’s comparison with Ellis Island’s historical immigration process. He recounted how his grandmother passed through Ellis Island during a time without stringent immigration laws or reliable databases for background checks. He noted that 98% of Ellis Island immigrants were admitted to the U.S.

Contradictory Cases

The DHS listed at least 12 instances contradicting Goldman’s statements, including cases where New York authorities released illegal immigrants despite ICE detainer requests. This list included a Dominican national involved in attempted murder and a Turkish national on the Known or Suspected Terrorist (KST) list.

These cases illustrate the complexity and contentious nature of immigration law and enforcement in sanctuary jurisdictions.
