Democrats Push for Reforms in the Supreme Court Amid Upcoming Elections

Proposed Changes to the Supreme Court

With the midterm elections approaching, Democratic legislators have put forward proposals aiming to reform the structure and operations of the Supreme Court. These proposals come amid rising concerns over the impartiality and effectiveness of the judicial system.

One significant proposal suggests increasing the number of Supreme Court justices from the current nine to thirteen. This change intends to provide a broader representation within the court. Another proposal focuses on revising the terms of justices. Instead of lifetime appointments, a fixed term of 18 years is being considered. Such a change aims to ensure a regular and systematic infusion of new perspectives into the court.

Establishing Judicial Ethics and Transparency

Beyond structural reforms, there are also calls for enhancing the ethical standards governing the Supreme Court. Legislators propose the creation of an enforceable ethics code. This code would guide the conduct of justices, ensuring accountability and transparency.

In addition, measures are being considered to introduce clearer standards for the court’s decision-making process, particularly concerning the ‘shadow docket.’ The shadow docket is often criticized for its lack of transparency, as it allows the court to make significant decisions without full briefing or oral argument.

Demonstrations have highlighted the urgency of these reforms. In October 2025, protestors gathered outside the Supreme Court after conservative justices indicated plans to limit the establishment of majority-Black and majority-Hispanic voting districts. This has fueled further debate on the necessity of these proposed changes.
