Federal Judge Allows Trump Executive Order on Mail-In Voting to Proceed
A federal judge has decided not to block a March executive order by President Trump that targets mail-in voting. This order seeks to create a federal database of citizens to assist states with voter eligibility.
The ruling permits the Trump administration to continue efforts to involve the federal government in the electoral process, which is typically managed by state authorities. Proposed changes include involving the Postal Service and having the Homeland Security Department compile voter lists using Social Security and other federal data.
In his 26-page opinion, Judge Carl J. Nichols stated it was too soon for the court to step in, noting that the administration has not implemented much of the order yet. The potential harms anticipated by the lawsuit remain speculative. The judge mentioned that if evidence surfaces of burdens on state officials or voter confusion, the Democratic-aligned groups could revisit the court.
“The court recognizes that the Postal Service may ultimately issue a final rule that directly affects plaintiffs or their members, or that the government may develop state citizenship lists that omit specific individuals due to particularized flaws,” Judge Nichols stated. “Plaintiffs may, of course, renew their motions if and when those future actions occur.”
The Trump administration has been active since the previous year in gathering national voter roll data despite state and voting rights group objections. Several federal judges have dismissed their attempts to request voter information from states.
Democratic organizations and lawmakers challenged the executive order, arguing it violates federal privacy laws by compiling a centralized voter database and unlawfully interferes with state elections. The lawsuit involved groups such as the N.A.A.C.P., the League of United Latin American Citizens, and the Democratic Senatorial Campaign Committee, along with Senate Minority Leader Chuck Schumer and House Minority Leader Hakeem Jeffries.
