Judge Allows Trump’s Executive Order on Voter List to Proceed

A federal judge declined to stop President Donald Trump’s executive order creating a federal voter list and restricting mail voting. This decision paves the way for significant changes in election operations before this year’s midterm elections.

U.S. District Judge Carl Nichols, appointed by Trump in Washington, dismissed the request from Democrats and civil rights groups. They argued that Trump’s order might be unconstitutional since the authority to set election rules lies with the states and Congress. Nichols sided with the Trump administration, stating it was premature to block the order, as it hadn’t yet been implemented.

The Court recognizes that the Postal Service may ultimately issue a final rule affecting the Plaintiffs or their members, or that the Government may create State Citizenship Lists with flaws, Nichols wrote. Plaintiffs may renew their motions if future actions occur. Until then, preliminary injunctive relief isn’t warranted.

The legal fight now moves to Boston. Voting rights groups are attempting to block the executive order with a separate lawsuit in federal court. The Trump administration hasn’t released lists of eligible voters. Those who sought the initial halt stated they’re prepared to return to court if the administration proceeds with the voter list.

Juan Proaño, CEO of the League of United Latin American Citizens, one of the organizations requesting the stay from Nichols, remarked, We are ready to resume the fight if and when the administration takes those next steps.

Trump issued the order in March after a voting overhaul bill he supported stalled in Congress. The order would have the federal government compile a list of eligible voters and direct the U.S. Postal Service to deliver mail ballots only to those listed. Election officials voiced concerns that it could be abused and lead to chaos.

Trump, following his 2020 election loss to Democrat Joe Biden, has claimed mail voting is fraudulent and initiated a federal investigation into that year’s vote. Despite these claims, repeated audits and investigations found no widespread fraud. Trump has expressed a desire to take over election administration in Democratic regions.

Democrats and civil rights groups emphasized the urgency of Nichols issuing a restraining order during the primary season, as states were already preparing for the midterm elections in the fall.

This was Trump’s second executive order aiming to overhaul elections and voting. His first election executive order, introduced early in his second term, was blocked by multiple federal judges. That order sought to mandate documentary proof of citizenship to register to vote.
