A federal civil rights agency has decided to drop a subpoena enforcement action against Nike, recognizing the company’s compliance with information requests. This resolution stems from an Equal Employment Opportunity Commission (EEOC) investigation into Nike’s diversity and inclusion policies.
The EEOC filed a motion to dismiss the subpoena enforcement in a Missouri federal court. This came seven months after the court was urged to compel Nike to meet the subpoena’s requirements fully. According to court documents, Nike provided the necessary information and documents from March to August, resolving the issue without further legal intervention.
An EEOC spokesperson expressed satisfaction with Nike’s decision to comply voluntarily, though Nike chose not to comment on the matter. Nike was among the companies targeted by EEOC Chair Andrea Lucas in a campaign scrutinizing corporate diversity policies perceived as discriminatory against white men. Lucas had previously encouraged white men to report discrimination via social media.
The investigation into Nike arose from a complaint filed by Andrea Lucas in May 2024, which alleged discrimination against white employees. It focused on Nike’s public data and goals for increasing minority representation among its workforce. The complaint scrutinized programs and policies promoting racial and ethnic minority inclusion in leadership and mentorship opportunities.
The EEOC’s actions with Nike shed light on its typically confidential investigative process. The agency demanded extensive data on Nike’s hiring and employment decisions, layoff criteria, and race-related programs. Although Nike deemed the requests overly broad, the company had already supplied a significant amount of information and was continuing the process when the court action termed as an “unusual escalation” was taken.
