The Senate is seeking to expand President Donald Trump’s authority to impose tariffs globally. This follows the Trump administration’s recent refunding of billions in tariffs to U.S. companies.

Senator Rick Scott from Florida is spearheading the effort. His goal is to secure congressional backing for tariffs targeting countries with enduring trade deficits with the U.S.

Details of the Trade Deficit Elimination Act

The proposed legislation, known as the Trade Deficit Elimination Act, seeks to establish a framework permitting Trump to levy tariffs on countries posing trade deficits detrimental to U.S. national security, foreign policy, and economic interests.

This act mandates an annual watch list of such countries, curated by U.S. Trade Representative Jamieson Greer, to identify those with “trade deficit economies.” Following this, the act empowers Trump to adjust tariffs on imports from these nations to reduce trade imbalances with them.

Consultation and Exemptions

While the president and Greer would consult with Congress, namely the House Ways and Means and Senate Finance committees, they would not need legislative approval to enforce tariffs on listed countries. Certain essential products, critical to U.S. supply chains and national security, would be exempted if alternative sources are unavailable.

Scott expressed concerns about foreign nations leveraging access to American markets while restricting U.S. products, leading to adverse consequences.

Reaction and Support

The initiative arrives shortly after Trump’s administration refunded $100 billion in tariff collections. These tariffs were set under the International Emergency Economic Powers Act (IEEPA), which the Supreme Court recently determined exceeded Trump’s authority.

Senator Scott’s bill, currently supported by Senators Kevin Cramer and Tim Sheehy, proposes new powers distinct from IEEPA. This legislation, grounded in Article 1, Section 3, directly targets foreign trade.

Senator Cramer remarked that equitable trade was essential, supporting a leader willing to confront trade partners. The bill aims to offer new tools to address trade deficits and secure favorable agreements for American stakeholders.
