Tyler Robinson’s Defense Seeks to Block Trial in Charlie Kirk Murder Case
Defense attorneys are working to prevent a trial in the murder case of Charlie Kirk, examining motions to block the trial of suspect Tyler Robinson in Utah. During the investigation, prosecutors have presented multiple pieces of evidence, including surveillance footage, ballistics, a Dremel tool, DNA evidence linking Robinson to the weapon, and testimony from a roommate, Lance Twiggs.
Prosecutors in Utah are urging a judge to proceed with the trial for Tyler Robinson, arguing that the evidence is substantial. They are also opposing the defense’s attempt to remove the death penalty as a potential punishment. In their 19-page filing, prosecutors responded to a defense brief requesting Judge Tony Graf to dismiss the aggravating factor that could lead to the death penalty for Robinson.
The defense claims that prosecutors have failed to demonstrate the shooting posed a great risk of death to anyone apart from Kirk. However, prosecutors argue that Robinson allegedly fired his grandfather’s high-powered rifle toward a crowd of thousands. They state that several individuals were in potential danger, refuting the defense’s assertion that the bullet passed safely above the crowd. Prosecutors contend that the evidence establishes probable cause, showing Robinson knowingly endangered others.
The filing also counters the defense’s broader objections to the evidence presented in Robinson’s preliminary hearing. Prosecutors assert that Robinson did not dispute the evidence indicating he climbed to a rooftop sniper’s position, fatally shot Charlie Kirk, hid the rifle, disposed of clothing, and instructed his roommate to delete related texts.
Additionally, prosecutors accused Robinson’s attorneys of using outdated legal precedents that the Utah Supreme Court has since overturned. They emphasized the attorneys’ duty to inform the court of newer rulings.
Prosecutors also defend a charge of witness tampering involving Robinson’s roommate and mention a violent offense committed in the presence of a child. They argue a cartridge at the scene suggests Kirk was targeted for his political views, featuring the inscription “Hey fascist, catch.”
Tyler Robinson, 23, is charged with fatally shooting Charlie Kirk, 31, as he addressed an audience at Utah Valley University on September 10, 2025. Robinson has not entered a plea.
A hearing is scheduled on September 1 to determine if enough probable cause exists to bring the case to trial. The decision will rest with Judge Graf.
