Michael Roth, president of Wesleyan University, spoke against the Trump administration’s proposal to revoke tax-exempt status from private institutions that offer programs based on race. Roth emphasized that Wesleyan’s programs would not change in response to this proposal, highlighting concerns about its impact on students of color.
Roth argued that the administration’s initiative aims to pressure universities by threatening the dismantling of programs benefiting minority students. He remarked that the administration uses the IRS to propagate its ideology, which he considers an extraordinary overreach. The administration claims that race-based benefits are discriminatory, even when promoting diversity or addressing past discrimination effects.
Roth further explained that Wesleyan does not have race-exclusive programs but supports first-generation and low-income students, mainly students of color. Losing tax-exempt status poses serious financial risks for the university. He pointed out that institutions are preemptively changing or eliminating programs to avoid costly legal battles.
Currently, there is legal uncertainty regarding the IRS’s authority to redefine racial discrimination and revoke tax-exempt status. Legal challenges could delay the proposal’s implementation. The Treasury Department and IRS estimate that around 18,000 educational institutions may be affected if the rule is finalized and takes effect after May 2027.
Roth highlighted that anticipatory compliance is prevalent, with institutions altering programs to sidestep legal conflicts, which can incur substantial costs.
