ABC is experiencing an audience surge for its daytime talk show, The View. The recent episode featuring Vice President JD Vance attracted 3.3 million viewers, marking it the most-watched installment in over 18 months. ABC’s press announcement highlighted this success but did not mention ongoing disputes with the Federal Communications Commission (FCC).
The FCC is probing The View due to its policies on equal time for political candidates. This investigation was launched after Texas Democratic Senate candidate James Talarico appeared on the show. Disney’s ABC contends The View qualifies as bona fide news, exempting it from the equal time rule through a petition campaign urging recognition as a bona fide news interview program.
ABC’s campaign includes advertisements on TV and social media, encouraging viewers to tell the FCC to allow public choice. This effort counters the FCC’s accusation that ABC is misleading viewers. The campaign also runs online, and a commercial aired during The View, asserting, “Tell the FCC to let the viewers decide.”
The Media Research Center (MRC) wrote to the FCC to dispute ABC’s claim, presenting over 2,400 pieces of evidence illustrating The View’s political bias. MRC President David Bozell argued the show doesn’t meet news program standards, describing it as political advocacy masquerading as news.
Earlier this year, the FCC mandated broadcast networks adhere to the statutory equal opportunities requirement, citing the Communications Act of 1934. The longstanding exception for bona fide news exempts certain programming from equal time rules for opposing candidates, but the FCC asserts no current daytime talk shows qualify.
ABC criticized the FCC’s probe, citing potential implications for the First Amendment. The View has been openly critical of former President Trump and his administration. In 2025, a study by the Media Research Center’s NewsBusters found the show featured 341 guests, with only two identified as conservative. The anticipation of more Republican guests following Vance’s successful appearance remains uncertain.
