ATF Announces Policy Shift
The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) announced significant changes on Friday regarding the manufacturing and transfer of certain firearms accessories and types. Gun owners will no longer need to federally register or seek advance approval to manufacture or transfer silencers, short-barreled rifles, short-barreled shotguns, and “Any Other Weapons” (AOWs). This follows a federal court decision impacting the National Firearms Act (NFA).
Impact of Court Rulings
ATF Director Robert Cekada explained in a letter to federal firearms licensees that this policy change is in response to a federal court ruling that invalidates key provisions of the NFA. President, Congress, and courts have consistently supported this new direction, according to Cekada. The main focus remains on combating violent crime in American communities.
Legislative Changes
The One Big Beautiful Bill Act led to a reduction of NFA manufacturing and transfer taxes to zero dollars for specific items. This legislation prompted a federal judge in Texas to issue an injunction in August, asserting that Congress’s elimination of the underlying tax made the mandatory registration and transfer provisions under the NFA unconstitutional. Initially, this injunction applied to plaintiffs involved but was later extended nationwide by the Justice Department.
Reactions from Key Figures
John Commerford, executive director of the National Rifle Association (NRA), welcomed this shift as a historic milestone. According to Commerford, this decision reflects adherence to constitutional principles and removes unnecessary government permissions for lawful firearm ownership.
Continuing Requirements
While the specific NFA requirements and fees are suspended, transactions must still comply with the Gun Control Act. Licensed dealers are required to conduct standard background checks and maintain transaction records. Machine guns and destructive devices remain subject to NFA requirements, as federal approval is needed for transporting certain rifles and shotguns across state lines.
The ATF is still accepting voluntary registrations, though future changes in law could reinstate previous regulations without automatic grandfathering protections.
