David J. Rush, a former senior CIA official, has been ordered to stay in jail until his trial. This decision comes after allegations of hoarding over $40 million worth of gold bars from the federal government at his home in Virginia. The ruling was made by U.S. Magistrate Judge William Fitzpatrick, who highlighted Rush’s capacity for evasion given his professional background. “He’s in a different position than most people to flee and avoid detection by law enforcement,” said Fitzpatrick.
Rush faces charges for falsely claiming military compensation after his discharge from the U.S. Navy in 2015. Last month, his home was searched, resulting in the seizure of over 300 gold bars, around $2 million in cash, and approximately 35 luxury watches. According to an FBI affidavit, Rush had requested and received significant sums in foreign currency and gold bars for work-related expenses.
Defense attorney Jessica Carmichael dismissed allegations about the gold bars, describing them as “a non-issue,” unsupported by charges related to their discovery. She asserted that Rush acquired the gold properly and stored them securely. “Mr. Rush never claimed they were his,” she stated.
Justice Department prosecutor Gavin Tisdale countered, noting Rush’s violation of rules by keeping the gold bars at home. He argued that Rush’s conduct indicates he cannot be trusted to follow court orders. “Mr. Rush simply cannot be trusted to abide by this court’s conditions,” said Tisdale.
The FBI affidavit revealed that Rush, after enlisting in the Navy in 1997 and being discharged as a lieutenant in 2015, lied on job applications about his qualifications. Investigations uncovered false claims of being a Navy pilot and holding degrees from Clemson University and Rensselaer Polytechnic Institute.
The hearing included sealed sessions, during which the Justice Department outlined their growing evidence against Rush.
