Karim Khan, the chief prosecutor of the International Criminal Court (I.C.C.), faces suspension as the court’s member states deliberate potential disciplinary actions related to an accusation of sexual harassment. This ongoing situation has caused significant disruption within the institution for approximately two years.
The Bureau of the Assembly of States Parties, which consists of 21 members overseeing and managing the I.C.C., announced a decision regarding the allegations on Monday night. However, details of the decision and associated documents remain confidential. The matter has been forwarded to the full assembly for further disciplinary actions.
A source familiar with the decision revealed that most bureau members concluded that Khan, who was already on voluntary leave, had engaged in serious misconduct. Despite this step, Khan’s removal from his position as chief prosecutor will only occur if the majority of the full Assembly of States Parties determines he committed serious misconduct and votes for his removal.
According to a Reuters report, Khan’s legal team denied any wrongdoing, asserting that “the decision is unlawful, procedurally unfair, and unsupported by evidence.” The court’s procedural rules allow for the suspension of a chief prosecutor pending a final decision on disciplinary measures if the allegations are considered sufficiently serious. Nonetheless, the bureau clarified that the suspension does not predict the eventual outcome of the disciplinary process.
