Dallas Judge Delays Custody Decision in Surrogacy Case
A judge in Dallas has postponed a custody ruling, extending a temporary restraining order for another two weeks as the custody dispute over a surrogate-born baby with a rare heart condition persists.
The hearing on Tuesday provided the public with insight into the legal battle surrounding surrogacy and abortion. Anti-abortion groups and Republican officials have shown support for McKenna West, a nurse from Alaska who traveled to Texas to give birth under the state’s strict abortion regulations.
Parents Affirm Baby’s Well-being
The child’s parents, Nausheen Gilkar and Omar Ahmed, affirm their love and commitment to the baby. They dismiss any contrary claims. Omar Ahmed and his wife Nausheen Gilkar appeared in court on August 25, 2026, to address the matter.
The surrogate, McKenna West, delivered the baby in Dallas two weeks ago. She moved to Texas to prevent the requested termination of the pregnancy. West’s journey from Alaska began around her 20th week of pregnancy when doctors diagnosed the baby with hypoplastic left heart syndrome. This is a severe congenital condition in which the left side of the heart is underdeveloped.
Court Intervention
Texas Attorney General Ken Paxton’s office intervened in the case, ensuring medical attention for the newborn and obtaining a court order assigning Gilkar and Ahmed the responsibility for medical decisions. The court reinforced this decision with a restraining order.
According to the Cleveland Clinic, children with hypoplastic left heart syndrome typically require three surgeries, beginning within two weeks of birth. The baby has already undergone the first surgery. Future operations are planned at 4 to 6 months and later at 18 months to 5 years.
Emotional Courtroom Scenes
The court heard emotional testimony from Nausheen Gilkar, emphasizing the couple’s efforts to secure vital treatments for their child. Gilkar explained that the couple did not prefer surrogacy initially, but it became their sole option. She shared her disappointment, testifying that West never informed them of her travel to Texas and cut off their access to their child’s medical information.
“She’s making us go from doctor to doctor,” Gilkar testified, calling West’s actions unstable.
McKenna West acknowledged withholding access to medical records. During her testimony, West expressed a willingness to relinquish custody claims if the couple agreed to continue the baby’s essential medical care.
Meanwhile, the newborn remains in critical care, with Gilkar detailing the severe complications faced, including a lack of blood flow to the left heart, post-surgical breathing difficulties, and the need for a transfusion. Gilkar reiterated their devastation and commitment, stating, “We’ve never wanted anything more than those babies.”
