Fauci Faces Contempt of Congress Vote

Anthony Fauci, the former head of the National Institute of Allergy and Infectious Diseases, attended a Senate Homeland Security and Governmental Affairs Committee hearing on July 29. At 85, Fauci, now retired, played a key role in the U.S. government’s coronavirus pandemic response.

The committee, controlled by Republicans, considers holding Fauci in contempt of Congress. This follows his refusal to answer questions in a recent hearing, where he invoked the Fifth Amendment, which protects against self-incrimination. Fauci claimed in his opening remarks that Sen. Rand Paul, R-Ky., the committee chairman, has an ‘unhinged obsession’ with him, aiming to trap him into committing perjury.

Fauci expressed his reluctance to invoke the Fifth Amendment, given his respect for legislative proceedings and history of cooperation with Congress. He explained that his legal counsel advised him to use this constitutional right.

Fauci asserted that he had already provided answers to many of the committee’s inquiries in earlier testimonies. He has had ongoing disputes with Paul regarding the origins of the pandemic. In recent developments, Paul unveiled over 1,000 pages from Fauci’s private diary, alleging they expose hidden doubts about the pandemic’s origins.

During the hearing, Paul suggested Fauci should feel comfortable testifying due to his immunity from prosecution for pandemic-era actions. This immunity derives from a pardon Joe Biden granted for acts from 2014 to January 2025. This pardon, described by Biden as ‘preemptive,’ anticipates Republican scrutiny of Fauci. However, it doesn’t shield Fauci from post-2025 prosecution, including current congressional testimony.

If Republicans decide to hold Fauci in contempt, the Justice Department will determine whether to pursue criminal charges. Though prosecutions of this nature are infrequent, two ex-Trump advisers, Steve Bannon and Peter Navarro, faced contempt charges during Biden’s presidency. Many Democrats perceive a similar threat for Fauci, referencing cases of former officials criticized by Trump, like former FBI director James Comey.
